Last week in Birmingham I caught up with Chris Baker, from The Long, Long Trail website and FouteenEighteen.co.uk after he had just given one of his very popular talks to a group of enthusiastic family historians on the subject of Military records.
Chris had discovered the rich military records set on TheGenealogist and was thus able to tell his audience about some of what he found useful on that website.
He particularly drew our attention to the Casualty records sourced from the War Office and told us how well done and useful TheGenealogist website was for Military researchers of the First World War with some interesting niche record sets.

they’ve got some casualty lists that were newly digitized
from the War Office originals. I personally found it extremely
well done and very helpful and I contacted the

And it just led to us being here and me being invited to give the talk.

I have been looking into the English family tree for a client that lives on the other side of the world recently.
It was easy, using the census and BMDs to quickly trace the family line back from Surrey and the South London area in the 1960s to Shoreham in Kent around the middle of the 18th Century. There then followed a nice trail, in the parish church registers, of one generation after the next being baptised following obvious marriages of the parents. Suddenly, however, I lost the connection as one set of parents seemed not to have conveniently married in St Peter and St Paul, Shoreham.
As it happened I had noticed that the Hearth Tax Online website http://www.hearthtax.org.uk/ had published a 1664 Kent Hearth Tax list and with one click I was able to see the return of names for the various parishes of the county.
Scrolling to Shoreham I found one incidence of the client’s family surname and so we can suppose that if we could trace his line back that this is where it would point to.
While this Hearth Tax payer in Shoreham may have been an ancestor, I can not advise my client that this is definitely so. What I have told him is that his family may well have been living in this village at the time that Charles II’s government hit on the idea of taxing his citizens at 2 shilling a hearth in the late 17th century. It helps us see where the tree is possibly pointing as we do more research in the primary records.
The hearth tax was a type of property tax on the dwellings of the land payable according to the number of fireplaces the occupiers had. The 1662 Act introducing the tax stated that ‘every dwelling and other House and Edifice …shall be chargeable ….for every firehearth and stove….the sum of twoe shillings by the yeare’. The money was to be paid in two equal instalments at Michaelmas (the 29th September) and Lady Day (25th March) by the occupier or, if the house was empty, by the owner according to a list compiled on a county basis and certified by the justices at their quarterly meetings. These quarterly meetings conducted within each county were known as the Quarter Sessions. The lists of householders were an essential part of the administration so that the returns of the tax could be vetted and for two periods 1662-6 and 1669-74, one copy of the relevant list was returned to the Exchequer and another was held locally by the clerk of the peace who administered the Quarter Sessions.

I was back in the area of Jersey where I grew up today.
It was not my family history that I was researching, but ancestors belonging to someone else.
I had received a request to take a photograph of the house in which my contact’s forebears had lived and so I went to my computer and opened TheGenealogist.co.uk and looked up the head of the household in their Channel Island records.
This site has some “Jersey Almanacs” which are very useful trade directories for the islands and soon I was on the trail.
The Genealogist also has the full run of census data and images, which I next used to quickly find the person in question.
Unless you are new, to family history research, then you will be aware that the census collections are also available on Ancestry and Findmypast as well. I tend to use all three sites, as sometimes the transcription on one may help me better locate a person with a difficult name spelling.
In the 1901 and 1911 census it was quite plain that the family in question lived around the harbour at St Aubin, in the parish of St Brelade. The census in each case clearly gave the name of the house, though it was different in 1911 from 1901 so there was the possibility that the family had moved a very short distance. Either that or they had changed the name of their house.
So a simple task, you may think. All I had to do was pop along to the road in question and snap a building. Even if the house name was no longer visible, or had changed, there was bound to be a property in the road that had retained its name and I could use as a reference point. All I would need to do is count down the houses from that one.
Oh that it was so easy! You see the harbour front has some alleyways off it and these had different road names today from the ones used in the census. It seems to me that the parish has gone back to using the older French names for these roads from the Anglicised ones used in 1901 and 1911.
Another problem was that off these alleys were some semi-detached cottages, some of which are reached via foot paths. Also there were a set of steps, leading up to the steep Market Hill that rises behind the harbour, on which three more un-named cottages perched.
Both of the census records ignored the Methodist Church, that sat in the middle of the harbour frontage between one of my reference properties, as is to be expected if it had no residents to be counted. But it was also obvious that, in times past, some of the other buildings would have been warehousing, or other uninhabited commercial buildings and so these too were not enumerated. This made my task of counting down the houses to the ones for which I was searching, difficult.
I consulted the “Description of the Enumeration District” as in some cases this can give you a good idea of the enumerator’s walk. In this case it mentioned the names of the roads, in general, but did not explain how he had dealt with buildings set behind each other or to the side.
By finding some more reference buildings, that is those that have retained their names through to today, I was able to tie down the house in the 1901 to being on one plot. I am not certain that it is the actual building as it may well have been built later, it not having many of the period features of its neighbours to give away its age.
So only a partial victory for family history research this week, but the Description of the Enumeration District can be a useful tool elsewhere and browsing through a road on the census can often be illuminating in other ways. Sometimes you may find more members of the family living close by and a child missing from one house in its grandparent’s or Aunt and Uncles. I remember finding this in my own family in Plymouth.

I was completely stuck finding this person’s birth, marriage or death and I had tried looking online and off without any luck.

What broke the problem for me?
Well it was avisit to a Family History websitewhile surfing forkeywordsto do with the ancestor and then a little bit of time spentbrowsing the transcripts featured on the platform.
There were some other factors, such as trying different spelling variations of first and second names, as advised by my family history teacher at the time and a visit to an archive.
What it boils down to is using a bit of lateral thinking in our family tree research and most importantly finding out about alternative records to the ones that we might have already used.
The family branch that has presented me with the most frustrating problems has been that from Devon. I was fine going back through the census years, 1911, 1901 and so on back to 1841 but then it became more of a problem.
Perhaps this story resonates with some of you to?
I had figured out that my 3x great-grandfather was called John Thorn. This was provided in the information he had given to the census enumerators over the years, along with the fact that he had been born in about 1795. His wife, Elizabeth, had been born about 1798.
As I belong to The Society of Genealogists I took a trip to their headquarters in Goswell Road, London knowing that they have the largest collection of Parish Records in the country on microfiche. They’ve also got some transcripts of parish registers in their library, which I thought may be worth looking at.
If you are in the area I highly recommend you visit the Society of Genealogists.
Unfortunately for me, at the time of my research, the Dartmouth parish records were not on microfilm at the SoG. But I was over the moon to find a great selection of Devon Family History Society booklets for marriages taking place in the churches of the town, including St. Saviour’s, Dartmouth. Browsing one book for any likely ancestors I spotted that on 13 April 1817 one person called John Thorn got married to an Elizabeth Sissell.
I opened up the internet and began searching using my new lead. My mission was to hunt down any evidence that this was the marriage of my ancestors.
Doing a search-engine query for Dartmouth + family history steered me towards the Dartmouth-history.org.uk website belonging to The Dartmouth Archives. I discovered that this voluntary organisation had a really broad family history section and included a number of transcribed baptisms, burials, marriages and census records.
I could read the very same information, as I had seen at the SoG in London, on this niche site. The data began in 1586 and ran to 1850 and there was the marriage of John Thorn to Elizabeth and this time I noticed that the witness were given as John Adams and Sunass (sic) Sissell.
At the time I made an assumption that this last person was more than likely some member of the bride’s family. Could it perhaps be the father of the bride?
But that name “Sunass” just didn’t seem likely to me. Now I know that it was the best guess by the transcriber as it couldn’t be read properly in the original record.
From the information I knew that they had signed with a mark, thus they were illiterate and so the first name and the second had not been written down by the ancestors themselves.
When you are doing your own research you should bear in mind that our ancestors may not have had the ability to read or write and the minister may have interpreted the name as he had heard it said to him. In my ancestor’s case the surname “Sissell” could possibly have been “Cecil” or something entirely different. Consider saying the name with the regional accent and seeing what you come up with.
As for Sunass – at this point I was clueless!
The Dartmouth Archives website had not got any early enough christening records for John and Elizabeth and so I went over to the Latter Day Saints (LDS) website or FamilySearch.org and here I did a search for Elizabeth’s christening.
I was rewarded by a lead to a baptism in one of the other churches in Dartmouth, St Petrox, on the 16 September 1878. This child was the daughter of James and Sarah Sissill and she was christened Elizabeth Gardener Sissill.
You may notice that the spelling had changed to Sissill with an “i” and not an “e” again pointing to the vicar writing it down the way that he heard it.
I now jumped to a conclusion that the witness to Elizabeth’s marriage could have been her father “James” and this has been interpreted as “Sunnas” because a flowing “J” for James had looked like an “S” to the transcriber and the other letters had been misread as a “u” for an “a” and the double “n” as an “m”. All easily done.
So what I am emphasising here and I continue to do so in modules from my Family History Researcher Course, is to be wary of names and the way they were spelt. If you keep this in mind then some of the logjams we find in our research can be got past.
This breakthrough I had was down to finding that Dartmouth has an active family history website and then using their indexes in conjunction with other internet resources, such as the LDS site.
The first learning point is that you should always find out what other research may have been done, for the area your ancestors came from.
If you find a family history society, or local interest group with a website, can any of their publications or website pages help you with your quest?
Secondly, always keep in mind that names were misspelled in many records. In my own family research I have had to think of other spellings for the Sissells, and indeed names that may have sounded like Sissell in order that I may trace this line back further and break down the brick wall.
I have made some fantastic strides in my family tree research and it is mostly down to learning as much as I can from other’s experiences and finding out as much as I can about what records and resources are available.

I took advantage of the holiday time to take a look at the Plymouth and West Devon Parish Records on the Find My Past website. Here you can view the actual scanned documents from the archive in Plymouth if you have a subscription or buy some pay as you go credits.
Although I already have copies of the GRO certificates it is interesting to also look at the church registers and glean some extra information. I got several pieces of extra information on one set of ancestors that I had not got before, from carrying out this exercise. I’ll keep these for further article posts!
One of the interesting finds from looking at the scanned church register was that they were married according to the Rites and Ceremonies of the Established Church “by Superintendent Registrar’s Certificate.
A while back, in my family history research, I came across a marriage “by certificate” in my family tree in Portsmouth.
In the year 1859 my 2x great grandfather, Henry Thorne married Ellen Malser in Portsea, Hampshire. By all accounts it was in a church of the Church of England and according to their rites, but I was mystified by the fact it was not either by banns or by licence.
My investigation at the time indicted that “by certificate†usually meant that the ceremony was conducted by a Registrar. This being common in nonconformist church weddings and at registry offices.
I sought out what Mark Herber had to say in his book, Ancestral Trails, and found the line: “From 1837 marriages could also take place before civil registrars, or in chapels licensed under the Civil Registrations Acts. The law permitted the superintendent registrar to issue a certificate (similar to an Anglican licence) authorising marriages (without banns) in licensed places of worshipâ€.
So here it was again in the 1866 marriage of another branch of my family and this time in Plymouth.
I have now found out that a Superintendent Registrar of a civil Register Office may issue a Certificate to permit a marriage to take place in an Anglican church on the following conditions.
One of the parties must have the required seven days residence within the registration district and within the parish where the marriage is to take place before applying for the Certificate.
Or the church where they wish to marry must be the usual place of worship of one or both of the parties.
The Registrar enters the details of the parties in a book which is open to public inspection and also displays a notice at the Register Office for 15 days. If no impediments are shown within the period of 15 days, a Superintendent Registrar’s Certificate can be issued and so it is similar to reading banns.
A clergyman, however, is under no obligation to marry people who have chosen this preliminary, and in practice clergy will recommend banns or a Common Licence.
I have found on Barbara Dixon’s site, a tutorial regarding marriages and she indicates that a marriage “by superintendent registrars certificate” is comparatively rare. http://home.clara.net/dixons/Certificates/marriages.htm
It’s used for a Church of England marriage but instead of the banns being read in the church, notice of marriage would have been given to the superintendent registrar.
A reason for so doing could be necessitated where services were held so infrequently such as in the case of a small chapel, that it was not possible to call the banns on three successive Sundays and get married all within the three months time limit.
In later periods it was sometimes used as an expedient if for some reason the vicar did not want to make the forthcoming marriage in the church public knowledge. Banns would have required the entry in the banns book, which was open for anyone to look at.
The types of problem that could have caused this course to be taken could have been where a bride and groom were of different faiths and the vicar either didn’t want the congregation in general to know, or even the bride/grooms family to be aware especially where he feared they might try to disrupt the ceremony!
Today it is sometimes used when one of the couple is divorced and the vicar does not want it generally known that he is marrying a divorcee in his church.
So, comparatively rare or not I find I have two sets of ancestors who took advantage of the Superintendent Registrar’s Certificate.
In the last posting about questions with my ancestor’s wedding certificate I discovered that the parish was not written on the document as I had expected it to be. Instead of St.Mary’s Portsea there was a series of pen strokes that seemed to begin with a P but could not be made out.
If you have read the comments, to that post, then you will see a suggestion from James Mac that it may have been a daughter church of St. Mary’s. He suggested I should try to tie down the incumbent, by using the resources of Crockford’s Clerical Directory. Well this is exactly what I did. In fact I used the 1865 edition that is available to search on Google Books for free.
From the copy of the certificate, that I had obtained from the General Register Office by post, I made out the name of the person marrying my 2x great-grandparents to be W H Rednap. I also noted that the marriage was by “Certificate”.
Now some folk have pointed out to me that “by certificate” usually means that the marriage was conducted by a Registrar. This is common in nonconformist church weddings and at registry offices. I turned to Mark Herber’s Ancestral Trails and found the line: “From 1837 marriages could also take place before civil registrars, or in chapels licensed under the Civil Registrations Acts. The law permitted the superintendent registrar to issue a certificate (similar to an Anglican licence) authorising marriages (without banns) in licensed places of worship”.
But even though the groom had been baptised in the Presbyterian church in Dartmouth, his wedding certificate indicates that it was carried out according to the Rites of the Established Church by one W H Redknap. Crockford’s confirms that William Henry Redknap was the Perpetual Curate of Milton, Portsea, in the diocese of Winchester from 1859, the year my ancestor’s married and formally the Curate of Portsea.
So then I looked into the history of Milton’s Church and found it was consecrated in 1841 and dedicated to St James, having been carved from the ancient parish of Portsea.
I do not know when in 1859 the Revd. Redknap took up his incumbency at nearby Milton, but my great-great-grandparents married in February 1859, in the early part of the year. So now I am leaning back towards the marriage having taken place in the main church of Portsea, by its curate before he moved to Milton. The Ancient Parish Church is St.Marys; but then this begs the question as to why it was “by certificate”?
I need now to consult the parish records of Portsea to lay this question to rest. Perhaps a trip to the Hampshire Archives is called for!
I’ve been dipping back into Mark Herber’s book “Ancestral Trails” published by The History Press 2005, looking at the subject of researching back before Parish records started in the mid-16th century. He warns his readers to expect difficulties tracing their ancestors in that time. It seems that before then, you are only likely to come across sporadic references to your ancestors – or perhaps more properly people who could be your ancestors – in wills, tax records or court documents. Herber writes that “… you are unlikely to be able to trace a line of descent in this period (and in particular find documents that evidence that one man was related to another) unless you find your ancestors in property records.”
Now property records can be found for people from various classes, those who were substantial land owners and also yeoman, tenant farmers and labourers. This is why it is said that English manorial documents are perhaps one of the few types of records in which genealogical information about the common man, as opposed to those from the upper classes, is likely to survive from medieval times.
So what was the manorial system?
In the England of the Middle Ages, land was held from the English monarch by a lord and on his land the peasants worked and received his protection in return. Anglo-Saxon society was, as in most of the other European countries, rigidly hierarchical. Social status depended on birth and family relationships. Power was gained through the ownership of land, as this was the principal source of wealth at this time.
After the Norman conquest of England all the land of England was deemed to be owned by the monarch. The king would then grant use of it by means of a transaction known as “enfeoffment”, where land grants or “fiefs” were awarded to the earls, barons, bishops and others, in return for them providing him with some type of service.
There were two sorts of tenure, according to the type of service rendered by the tenant to the lord, free and unfree. Free tenure can then be broken down into different forms again. A tenure in chivalry, for example “tenure of knight service”, would be where the tenant was charged to provide his lord with a number of armed horsemen. Mark Heber in Ancestral Trails points out that this type of tenure was soon commuted to a money payment (or “scutage”). He also explains that among the types of “free tenure” was to be found “spiritual tenure” where divine services, or “frankelmoign” by which a clergyman, holding land from the lord of the manor, would pay his due in prayers said for the lord and his family.”Socage tenures” existed where the tenant provided his lord with agricultural services such as ploughing the lord’s retained land for 20 days a year.
“Villein tenure” or unfree tenure applied to those men known as villeins, serfs or bondmen. This class of tenant was not free to leave the manor without obtaining the permission of the lord. They would be subject to many obligations, some of which were onerous and these individuals held their land in exchange for providing the lord a number of days work in return. This could be, for example, four days work a week -Â but the nature of the work could vary depending on what was required.
Manorial Documents are fascinating for family historians, as are will documents that were not the exclusive preserve of the rich. I shall explore this area again in other posts.
The problem of tracing an ancestor, with a common surname, is one of those brick walls that many of us come up against in our family tree research. When it occurs after the introduction of state run vital indexes, in 1837 for England & Wales and eighteen years later, in 1855, when Scotland adopted the idea, it can be difficult to find the exact person that is our forebear, but at least we have a central index to search. The Crown Dependencies followed suit at different times again, so you will see civil registration introduced into Guernsey in 1840, Jersey in 1842, Alderney in 1850 and Sark in 1915. The Isle of Man beginning compulsory civil registration of births and deaths in 1878 and then marriages in 1884.
But what about searching for a Smith or Jones in the years pre-civil indexes? If you are expecting an easy answer I’m afraid I am going to disappoint, as common surnames do present us family historians with great difficulties to overcome. Having said that, however, all may not be lost.
If the ancestor in question has an unusual first, or middle name, then this may help you enormously to single your likely candidate out from the others. In my own research it was not the actual man I was trying to track down who had the unusual middle name, but his son. I had already made the connection to John Branton Thorn via the prime sources and knew him to be my ancestor. I was now on the trail of five or six John and Sarahs who were candidates for his parents, according to his baptismal details. So which of the various John Thorns who married a woman whose first name was Sarah in various parts of Devon jumped out as a strong possibility? It was the one where the bride’s surname was Branton.
The advice I have been given is to try to tie the person with the common name to one with a less than common one. It could be their wife, a brother or sister and so on and perhaps it is an unusual first name, middle name, or maiden name you can use.
If you are not able to find your ancestor for certain in the church registers, then always remember that the Bishop’s Transcripts may possibly harbour more information than the register did. It is not a certainty that it will, but it is worth a look.
Try using Wills and Admons to see if you can find the possible parents (or a brother, sister or other relation) naming your ancestor as a beneficiary.
Another point to be aware of is that even with a less common surname there can be many problems to overcome in family history research. As spelling of surnames varied so much, until the mid 19th century or later when they became more fixed, and with many of our ancestors not being literate, the clergy often recorded the name as they thought they heard it and so a regional accent is probably responsible for one line of my ancestors being recorded as Sysal, Sissell, Sissill and Sizzall in the church records from 1780 to 1798.
If the person you are researching was born in the years just before civil registration began, but was likely to have died after the death registers began, how about looking for them in these records. You can also use the church burial records, if you know the parish they died in. What about trying the National Burial Index? If you just have a first name and a common surname I grant you that this is not going to be much help to you but if you know the place that they lived then you may be able to narrow down you likely forebears.
On the subject of places, some names can be very common in one area, for example Thorn/Thorne in Devon, but a common name may not be so common in another place.
Advice that I have seen given on other blogs and forums say that you should:
Learn as much identifying information as you can about the ancestor you are researching.
So look for family bibles, they can list the names of children. Think about whether there are any other records for the district where your ancestor lived that they may have been recorded within? Taxes, land records, muster rolls, etc.
Make a chronology of the ancestor’s life if you can; where did they live for the various events in their lives? Can you identify the street, the town or hamlet for the significant moments in their time-line? If you can then you have a framework to work with.
Common surnames are certainly a problem for family history researchers trying to populate their family tree and sometimes there will be no easy answer. Persevere, however, as more and more records become available there is always a chance that your ancestor may be within one of them.
A question I am often asked is how do I trace my UK family tree?
Taking the journey into the unknown territory of the past can be a mixture of exhilaration and tedium. You will meet with misspelt names, birth dates that vary from one census to another, missing ancestors and be led down blind alleys. But when you finally meet up with that elusive ancestor the joy of success will spur you on with your research.
Like every good journey it starts with the first step, so buckle up your genealogical seat belt and Ill guide you through the first important stages.
First find any birth, marriage and death certificates, correspondence, insurance policies, ration books, etc. These will be of great help to you as you start your research. Anything that will give you details of your parents or grandparents. Gather up as much information as you can and jot it all down to start your tree. Lay the tree out as the youngest first and work back. You can download blank family tree charts on our site if you wish, then start completing your family tree as far back as you can.
Keep detailed notes on each person. You will thank yourself for this action when you find that you are retracing back and forth to verify information. I cant stress this enough, you must be sure that you have the correct records for your ancestor, not somebody else’s. It is quite an easy mistake to follow the wrong family back through the centuries as names can be similar and sometimes the same. I found that my great, great, great grandfather had a detail double, with the same name, the same year of birth and the same place of birth. It took 2 months of research into each one, retracing details back and forth to tie in the right man! I almost felt I could claim the other man as an ancestor, I knew him so well in the end!
Your initial aim is to collect enough verified information to take you back to 1911, at which point you can delve into the world of census records and begin to unlock the doors to your past. Within the census your ancestors will come alive for you.
Don’t worry if you cant find any certificates lurking in drawers or boxes, armed with only your parents names you may still be able to trace back through the years, although you will have to buy birth and marriage certificates. I managed to trace my family tree knowing only the names of my parents and their dates and places of their birth. I needed to buy my parents’ birth certificates so that I could find out their parents details, thus keeping the trail going.
To overcome this type of problem I recommend you sign up as a member of a genealogical website, and then start searching their records. My first search was my fathers name, date and place of birth the results showed all the possible matches with my dad at the top of the list. I clicked on the link and it took me to the registered GRO entry for his birth, which in turn gave me the index reference details:

Every event of birth, marriage or death registered in England and Wales is allocated a reference by the General Register Office. Next I went to the GRO website (www.gro.gov.uk) and purchased my dads birth certificate. I repeated the same process for my mum.
By supplying the index reference the correct entry can be located by the GRO and the certificate will be sent to you. You can also purchase certificates from registration offices, but if you want to research online without having to travel miles then the internet is the way to go.
I sat back and waited for the post, it took about 7 days for the certificates to arrive. I opened them with anticipation and I wasn’t disappointed. I had in front of me the full details of my grandparents, their names, addresses and occupations. I used this information to find their marriage, which in turn gave me their fathers names and this was all I needed to take me back to the census records and from there fly back in time to meet my older ancestors.

We all know that in today’s new economy people are getting themselves into debt. Worse still, for some, is the prospect of going bankrupt. It may seem that bankruptcy is a modern phenomena, well it isn’t. Getting into debt was also a common problem for our ancestors as well. As we all love a skeleton in the cupboard, just how can we find out if one of our family has had the problem to face back in the Britain of the past? It would seem that we may be able to find out more online.
In my research into my family tree I remember chancing on some family notes that, on face value, seemed to identify one of my ancestors as having been a partner in a business enterprise that had failed. To start with I had had no inkling that my forebear, in question, had even been a merchant, so to learn that his enterprise had eventually hit the rocks was an interesting nugget of information in itself. As a bookseller, myself, and having read the Charles Dickins novel called Little Dorrit, which you will no doubt know is set in within a debtor’s prison, I wanted to find out if my own ancestor had faced being declared bankrupt.
In England, Bankruptcy goes all the way back to a statute of Henry VIII in 1542. The 1571 Bankruptcy Act brought about the idea that a bankrupt person would be able to settle their debts, by distributing what remaining assets they had, through independent commissioners. Up until 1705Â the unfortunate debtor could never be discharged from bankruptcy and so the stigma would remain with them for ever!
Legally, Bankruptcy is a process in which a court official assumes charge of a qualifying debtor’s property so that a distribution can be made to the creditors of the debtor in a proportion to the sum that they are owed.
Only in the year 1869 was it that individuals who were not undertaking a business of some sorts were able to become bankrupt. Before this date, ordinary people were known as being insolvent instead. These souls faced being sent to debtor’s prison and were not released until they had found a way to pay off their creditors. Bankruptcy, as such, applied strictly to people who were traders, that is those who bought and sold goods, or who worked some materials into things that they then sold.
District bankruptcy courts were first established outside of London from 1842. Then their jurisdiction passed on in 1869 to the County Courts. In the capital city the London Court of Bankruptcy was set up in 1869, before being absorbed into the High Court of Justice in 1883. Independent assessors, known as Commissioners, would determine if a debtor was eligible for bankruptcy or not. If they were satisfied that bankruptcy could take place, then they would publish a notice in the London Gazette declaring the debtor bankrupt. Also posted would be a list of potential creditors along with the dates set for meetings. The London Gazette’s archives are easily searched today on-line at www.london-gazette.co.uk. This is a fantastic resource for any family historian hot on the trail of a bankruptcy. You are able to search the archives by date and name, then view a pdf image of the pages that your results have found. The London Gazette has been published since 1665 with a regular publication of bankruptcies stretching back to 1684 and also 1712 for insolvent debtors. Family historians can locate case files for English bankruptcies at The National Archives in Kew, while Scottish sequestrations are to be found at The National Archives of Scotland. Unfortunately, for us, the majority of case files for England have not survived, but those that have are indexed on TNA’s online catalogue.
Other resources to consider are journals that published similar notices to the gazettes. These will include The Times; The Gentleman’s Magazine; Perry’s Bankrupt & Insolvent Gazette (1828-1861) and Perry’s Bankrupt Weekly Gazette (1862-1881). If you are looking for notices of bankruptcies in the County Court, then you will probably need to turn to local newspapers for the area in question. The British Library would be the place to look for these. Now we are also able to search contents of newspapers at http://newspapers.bl.uk/blcs.
Insolvent ancestors can be an interesting topic of research. Remember, however, that their hardship carried much more stigma than it does today. In modern times we can go into debt, declare ourselves bankrupt, or wipe out a huge chunk of our debt with the alternative Individual Voluntary Arrangement IVA. And yet none of us lives in the fear of being incarcerated in the debtor’s prison in the 21st century.
