When Ancestors Dissapear from the Records

I was pretty confident of this ancestor search. I thought it was going to be a breeze to find the family history records for this family group. I had located the family in the 1881 census through a combination of knowing the names of the parents and the birth dates of the father and mother.

So next box to tick was to find them in the 1891, 1901 and 1911 census for England & Wales, or at least those parties that had survived as there is always the possibility that some may have passed away between censuses.

But straight away the 1891 census proved a problem for me. I search using the head of the household, then his wife and then the children. Nothing!

I wondered if the surname had been poorly transcribed and so I used the option to search on a name that would have been similar, with no result. I then went back to the 1881 and took a look at the street name and town with the intention of seeing if they had stayed put in the ten years between the census being taken but their surname had been incorrectly gathered. This is a top tip that I was given some time back and on www.thegenealogist.co.uk there is a useful tool that allows researchers to search the census by street name. I’ve used this in the past with success, but the whole lane seemed to have been missed out, or had changed its name in the intervening period.

There is also the facility on www.findmypast.co.uk to do an address search and so I tried using that and quickly identified the road as it had been listed slightly differently in the later census. This shows up the beauty of using more than one site to do your research with. If you can’t find a record in one subscription site’s records then remember this tip is to try using another site, because each company will have used different transcribers to produce their indexes and so you may get lucky with your brick wall.

On thegenealogist.co.uk there is another tool called the family forename search that allows researchers to enter a number of the first names from a family.

This is a fantastic way of digging out difficult to find families in the census. With this feature you are able to search for a family that you have not been able to locate using the surname – possibly because of some unexpected spelling variation. You can use the forenames only as a group search and the results can be refined by adding or subtracting a surname or family members.

As many families had a large number of children, the odds of another family in the same county being an exact match is quite remote. It is possible to narrow the search by year and county, if required, and enter up to 6 possible forenames that you would be expecting to find within a family group.

Help Me To Get Back Before 1837 In English & Welsh Genealogy

A great many people who are researching their forebears from the British Isles, discover that there is a massive amount of family history information on the internet for the years going back as far as 1837 in England & Wales. Then, as I pointed out before in a previous article of mine about tracing an English family tree before 1837, it would seem to become more difficult for us researchers. What is the significance or the year 1837? This is the date when civil registration started in England & Wales. The state took over from the established church the registering of all the citizen’s vital records.

You may have been amazed at the ease you had finding later records of your ancestors on the subscription websites like Ancestry, or TheGenealogist.co.uk, but then as you go back before the census records and the government run data for Births, Deaths and Marriages, you will have found that only a small number of all the genealogical records, that there actually are, have made it on to the net.

Parish Records can usually be found in the County Record office, or in a few cases the incumbent minister may still have retained them at the parish church. How do you decide which parish your ancestors would have fallen into? This is the value of getting hold of Parish maps for the relevant counties that you are researching. These maps will not only show the boundaries of each parish, but also those of the adjacent parishes, which can be extremely useful for tracking those ancestors who tended to move about!

Gaps can occur in the parish registers because of changes in regime, such as the English Civil War. Yet another political reason for missing parish records is the effect a tax can have on them. An example of this was that in 1783 a stamp duty of 3 pence on every entry in the parish registers was imposed by the government of the day – although paupers were exempt. As with all taxes people seek ways to evade them and so, with the collusion of many church ministers, you will discover that there is a decline in the number of middle and working class entries of baptisms, marriages and burials. In contrast there is a corresponding increase in the number of pauper’s entries! The Act was repealed in 1794, having been found to be largely unsuccessful.

An Act of Parliament, in 1812, required baptisms, marriages and burials to be entered in separate and specially printed books. These books provided for only eight entries per page and required more information to be gathered on the individuals than had been the common practice.

Baptismal entries now included the Father’s occupation and the Mother’s maiden name. Marriages, henceforth, included the parish of origin of both parties, their names, if they were a bachelor, spinster, widow, etc., their ages, the parties signatures or marks, and also those of two witnesses.

Entries for burials now included the age, occupation and abode of the departed and between 1678 and 1814 an affidavit had to be sworn that the deceased was buried in wool to help the economy or a fine of £5 was payable.

Marriages could have been solemnised in the Church either by banns, or by licence. Family historians, searching for their ancestors, will find that banns are recorded in the parish register. The reading of bans was the process where the couple’s intention to marry would be read out on three occasions in the parish churches of both parties. So if you know the place where the bride-groom lived, just prior to his marriage, this record will also give you the information as to the parish of his bride. Normally the wedding is likely to take place a few weeks later and so this gives you a time period to search. Marriage Licences themselves will probably not have survived the years as they were sometimes handed to the couple intending to marry. But fear not, because a search can be made for the marriage licence’s bond, or allegation. This is a document that can give up some useful information for family historians as names of those who stood surety, along with the names of the bride and groom, place of marriage and in some cases the occupations of the sureties and groom are recorded.

These are just some of the documents that you can use to help you get your family tree back beyond 1837 in England & Wales.

Tracing my Great-Grandfather in Trade Directories

I’ve used trade directories before, when I was tracing my tradesmen ancestors down in Plymouth. At that time I’d found one enterprising forebear, of mine, who had been a Victualler and Brass founder on the 1861 census employing  one woman, six men and some boys in this Devon City. This had lead me on to use the University of Leicester’s site, Historical Directories at www.historicaldirectories.org to find him and his advertisement in a Plymouth Trade Directory. Its great fun to see how polite were the requests of a Victorian era businessman, asking for trade, in an advertisement from this time.

This week I had turned my attention to my maternal great-grandfather. In a book, complied on the family, that I was lucky enough to have found on the shelves of the Society of Genealogists, in Goswell Road, London, my ancestor was given a brief mention in between his more illustrious brother’s, cousin’s and forefather’s. What I was able to glean, from this book, was that Edward Massy Hay had been a merchant in London for a period in the 1860’s, after a short spell in the army.

The book had been complied by his Father, Charles Crosland Hay and completed by his cousin on the death of the former. It gave me a clue that all was not well in the business world of Edward, as a line simply said: “Partner in the firm of Stevens & Hay, Merchants in London; on its failure he became a tea-planter in Ceylon.”

My first reaction was to see if the business went bankrupt and was mentioned in the London Gazette. I checked the website at www.london-gazette.co.uk, where it is possible to search back through the archives for free, but I found nothing on the business. I’d read a tip that it was always worth checking the Edinburgh and Belfast Gazettes, in case the bankruptcy had been hidden in one of these publications. The results came back negative and so it looks as if the business was wound up without going bankrupt.

Recently, on taking a look around TheGenealogist.co.uk‘s data sets, I came across the 1869 Kelly’s Post Office Directory for London on their site. By entering “Stevens and Hay” I was eventually able to locate their business to an office at 65 Fenchurch Street, London. EC3

Moving on, to a Kelly’s Directory for 1880 London, I found my great-grandfather listed as living in Princes Square, Bayswater, London. Also at that address was his sister, Mrs Mary Ann Webster, whose husband was in the Madras Civil Service. But I had already begun investigating the move to Ceylon (today known as Sri Lanka), by my ancestor. By 1880 he was appearing in a directory for that island, as well as at Bayswater!

From a website, dedicated to the history of Ceylon Tea (www.historyofceylontea.com), I found there are links to many years of the Ferguson’s Ceylon Directory. In 1880 Edward M. Hay was an Assistant for R.Books & Co of London, in the British Colony. He appears in several of the directories, one of which has him as Chairman of his local area’s planters association and in 1905 he was listed as the owner of a tea estate called Denmark in Dolosbage, Ceylon.

This little peep into my great-grandfather’s life was made possible by the use of various trade directories and the fact that they have been scanned and uploaded to websites on the internet. But before I turned off my computer, on a whim I decided to enter the address that he had shared with his sister in London into Google street view. I was rewarded with the Georgian fronts of Princes Square and easily found the house where he lived. It is now a small hotel and so its address is on the internet.

A search for 65 Fenchurch Street, and the offices, shows that they have been replaced by a modern vista. Lastly, I did a Google search for the Denmark Tea Estate in Sri Lanka and by chance it still exists! Using Google Earth I was able to use the satellite view to see, from the air, the hillside estate that once was where my great-grandfather cultivated tea.

It seems to me to be well worth using some of these alternative tools, available to us, when doing family history research. They may add just a little bit of flesh to the bones of facts gained from the census data or the birth, marriage and death records for our ancestors.

Administrations in England & Wales up to 1858

If one of your ancestors, in your family tree, died without making a will, then their next-of-kin could apply
to the church courts for Letters of Administration to be granted to them. What would happen is that they
would then be bound in law by entering into a bond to administer the goods of the deceased. As well as family it is sometimes possible to find that a creditor is granted the letters of administration, but in all cases they are referred to as an Administrator, if they are male, whilst a female is known as an Administratrix.

You may well notice that administrations, or sometimes admons,are generally less informative for the family historian than wills are. That said, however, If you have found that one of your ancestors left no will, but their effects were dealt with by and administration, then at least the document will include: the name of the administrator(s) and bondsman, as well as the the relationship of the administrator(s) to the deceased. This could indeed be valuable to someone tracing their family tree. In addition to which, the administration may often include a date of death and the value of the deceased’s estate, that could help you fill in some gaps.

As in the case of wills, until 1858 it fell to the church courts  to be responsible for granting administrations. So for that reason you will need to use the same system to find administrations as you would do for finding wills of the same period. The main point to remember was that it is the same two provinces – the Prerogative Courts of York and of Canterbury – each controlled by an archbishop, that England was divided into.

A subdivision then occurs into several archdeaconries, and then further divisions again into rural deaneries. What all this means to the researcher is that there are over 250 church courts who were responsible in some way for the granting of letters of administration.

So where do we make a start? One answer is to take a look at the A2A website (Access 2 Archives) on the National Archives website:

It is a fantastic database covering a myriad of records from over 400 record offices across not just England, but the whole of the UK.  Some of their records go back as far as the eighth century, while some come right up to date.

It is possible to search it by name, or a place and also by a topic and while it may not cover every single record office, by the very nature of its substantial coverage it can be used to search for probate material by using the key words ‘wills, administrations or inventories’ plus the region of the country that your ancestor died within.

Wills & Administrations in English Family History

Wills can be of great use to any family historian for a number of reasons. They can furnish you with names of relatives, give you a description of the property that your ancestor owned at the time of their death and even reveal their favourite charity. Or though in my case I suspected that the charity that my aunt chose to leave the residue of her estate to was really her solicitor’s favoured charity and his suggestion!

Wills are one of the few documents written by your ancestor. For this reason they may give you an insight into their attitudes, social standing and their lifestyle. Perhaps, if you are lucky they can also explain family feuds and even expose scandals.

If, however, you discover that one of your ancestors seems to have been cut out of the will, you should always consider that this may not necessarily mean that they were disinherited. You should be open to considering that other arrangements had already been made for them in the lifetime of the deceased.

Quite a few family history researchers assume it is not worth checking if their ancestors left a will because they think their ancestor’s background precluded them from doing so. It is, however, wrong to believe that only a minority of people from the top of society left wills. Yes, it may be true that most people who left wills had some property of some kind or another. But wills can be found for people from amongst the very widest range of backgrounds.

Whilst it is perhaps true that only a small percentage of the population left a last will and testament, you should remember that for every person who did so means that there will be at least one other person mentioned in the document and this at least doubles your chance of finding a connection to your family tree, even if they are a distant relative.

It is possible, but not all that common, to find a will belonging to your family that pre-dates the parish registers, or even better where parish registers and the other primary sources have been destroyed or gone missing over the years.

You should know that before 1858 wills were generally proved in the church courts. In order to find a will in this time period will need you to have some understanding of the church hierarchy and how this bears relationship to the place or area that you are researching within.

So, what is a will?

It is a formal document stating exactly what a person desires should happen to their possessions after they have passed on. The person making a will is referred to as the Testator and they make a Last Will and Testament. This is actually a joint deed, the Will and the Testament.

Last Will and Testaments became the legal means of passing on one’s property in England in the year
1540. This was because it was only from that date that ‘Freehold’ land could be gifted or “devised” through a will. Before this date a “testament” was legally only concerned with what the law knows as “personality”. this is a term referring to personal property, that is a person’s moveable goods and chattels.

Why wasn’t it possible to pass on land? The answer lies with the fact that interests in “real property”, or the land and buildings your ancestors owned, would descend automatically to the deceased immediate heir. The church law, however, stated that at least one-third of a man’s property should pass directly to his widow as her dower and then one-third to all his children.

In theory these rules could not be broken, however property owners found ways that they could get around them. As an example, whilst “Copyhold land” – land held from the Lord of the manor – could not be left in a will before 1815, it could still be given up or “surrendered” to be used in a will. This effectively meant that it could be left to whomever a person wanted! Other methods of circumnavigating the rule was to transfer one’s property to trustees who would hold it during the owner’s lifetime as per that person’s instructions.

If you are lucky and find your ancestor has left a will you will see just how useful it is to the family historian.

Manorial Documents in English Family History Research

Ancestral Trails-The Complete Guide to British Genealogy and Family HistoryI’ve been dipping back into Mark Herber’s book “Ancestral Trails” published by The History Press 2005, looking at the subject of researching back before Parish records started in the mid-16th century. He warns his readers to expect difficulties tracing their ancestors in that time. It seems that before then, you are only likely to come across sporadic references to your ancestors – or perhaps more properly people who could be your ancestors – in wills, tax records or court documents. Herber writes that “… you are unlikely to be able to trace a line of descent in this period (and in particular find documents that evidence that one man was related to another) unless you find your ancestors in property records.”

Now property records can be found for people from various classes, those who were substantial land owners and also yeoman, tenant farmers and labourers. This is why it is said that English manorial documents are perhaps one of the few types of records in which genealogical information about the common man, as opposed to those from the upper classes, is likely to survive from medieval times.

So what was the manorial system?

In the England of the Middle Ages, land was held from the English monarch by a lord and on his land the peasants worked and received his protection in return. Anglo-Saxon society was, as in most of the other European countries, rigidly hierarchical. Social status depended on birth and family relationships. Power was gained through the ownership of land, as this was the principal source of wealth at this time.

After the Norman conquest of England all the land of England was deemed to be owned by the monarch. The king would then grant use of it by means of a transaction known as “enfeoffment”, where land grants or “fiefs” were awarded to the earls, barons, bishops and others, in return for them providing him with some type of service.

There were two sorts of tenure, according to the type of service rendered by the tenant to the lord, free and unfree. Free tenure can then be broken down into different forms again. A tenure in chivalry, for example “tenure of knight service”, would be where the tenant was charged to provide his lord with a number of armed horsemen. Mark Heber in Ancestral Trails points out that this type of tenure was soon commuted to a money payment (or “scutage”). He also explains that among the types of “free tenure” was to be found “spiritual tenure” where divine services, or “frankelmoign” by which a clergyman, holding land from the lord of the manor, would pay his due in prayers said for the lord and his family.”Socage tenures” existed where the tenant provided his lord with agricultural services such as ploughing the lord’s retained land for 20 days a year.

“Villein tenure” or unfree tenure applied to those men known as villeins, serfs or bondmen. This class of tenant was not free to leave the manor without obtaining the permission of the lord. They would be subject to many obligations, some of which were onerous and these individuals held their land in exchange for providing the lord a number of days work in return. This could be, for example, four days work a week -  but the nature of the work could vary depending on what was required.

Manorial Documents are fascinating for family historians, as are will documents that were not the exclusive preserve of the rich. I shall explore this area again in other posts.

Irish Family History Research Just Got Easier!

Ireland-Genealogy on the webIt’s a well known fact, in family tree research, that Irish family history is more difficult to do, than that of Ireland’s near neighbours, because of a lack of information and the deficiency of census records pre 1901. But this week I couldn’t help but notice several press releases about how three different websites were going to be able to ease that problem for family historians.

Back in March I spotted that Ancestry (www.ancestry.co.uk) had, for St Patrick’s day, updated its Irish Collection. This Ancestry said at the time was “the definitive online collection of 19th century historical Irish records.” It would, they said, make it easier for the nearly one in five Brits of Irish descent to explore their heritage.

In total, there are now more than 35 million historical Irish records on Ancestry.co.uk, including two million comprehensive new and upgraded records from the critical periods prior to and following the Irish Potato Famine (1845-1852), the single most significant event to drive 19th century global Irish Diaspora.

Next, I came across the news about a smaller enterprise called Ireland Genealogy (http://www.ireland-genealogy.com), this being a fascinating new web site for anyone doing Irish family tree investigation. It has its own database of Irish Pension Record applications, that enables you to lookup information extracted from the missing Irish Census and claims that this will help a researcher save both cash and time.

Their research workers have spent twenty years copying all these written pension applications (green coloured forms) and so giving us access to critical data from the 1841 and 1851 census records for all of Ireland. These pension public records are kept in the Public Records Office of Northern Ireland (in Belfast) and The National Archives, where they are available on microfilm, but this means that they could be quite tricky to understand as they are in no specific order. What is more, the records data held by P.R.O.N.I. are not indexed, adding to the difficulty of doing your research.

Ireland Genealogy claims that their database, of those pension applications, enables you to now look up this information with ease.

The third Press Release, that caught my eye, was from Brightsolid about the launch of their new website www.findmypast.ie on to the web. With online access, from the start, to over 4 million Irish records dating from 1400 to 1920s and the promise of over 50 million records to be available in the first year to eighteen months, this is a welcome addition to the findmypast family.

There are approximately 80 million people worldwide, who claim to have Irish ancestry, with just over half of this number (41 million) being Americans, the limited resources previously availble to them, to connect with their past, may at last be being redressed.

Findmypast.ie claims that they will carry “…the most comprehensive set of Irish records ever seen in one place, going back to 1400 right up until the 1920s, including the Landed Estates Court Records, the complete Griffith’s Valuation of Ireland and the Directories collection.” They will be offering high quality images of records on this site.

With the addition of these three resources, online, it would seem that Irish family research just got a bit easier.

Researching family in Jersey, part 5: Nailing down dates without certificates

As I mentioned last time, there are occasions where you find something in the BMD indexes and you can’t get to Royal Square in time to see the certificates. But there are two sets of data in the Archive that can help you to nail dates of marriages and deaths down.

The first is what is referred to as the “third copy” of the marriage registers. Individual parishes maintain their own registers and then send copies of the certificates to the Superintendent Registrar to compile the full volumes. However, in between the two the Superintendent Registrar maintains draft registers – and it is this that the Archive now possesses.

To access the draft registers, you need to use the Reference search facility on the OPAC. The collection reference you need is D/E: this will get you to the top of the collection. Reference D/E/B covers the third copy, and you will find that it’s divided into individual collections from specific Church of England churches and general collections of nonconformist and civil marriages from 7 parishes. It’s not quite a complete set, but the vast majority of material is there and you will find that most of the time there is at least some degree of correlation between the indexes and the draft registers.

As far as recording deaths goes, the simple answer is that there will almost always be a burial shortly afterwards. There are two ways that you can attack this problem: one is to look at the records kept by the cemeteries, and the other is to check the funeral directors. Cemetery records exist for two of St Helier’s major burial grounds – Almorah and Mont à l’Abbé – between about 1860 and 1950, and there are also records for some of the other burial grounds around the island including Macpéla, the non-conformist cemetery at Sion Village. These are all in folders in the reading room. One cautionary word: women are indexed by their maiden name only (although the married name is given).

The Archive also received a major deposit from a local funeral director the other year, containing records of seven of their predecessor companies, some of which go back to about 1820. Again, you’ll need to use the OPAC’s Reference Search, and this time the collection reference is L/A/41. Be aware that for any given period you may have to look at two or three different companies’ books – but feel free to enlist the help of the volunteer from the Channel Islands Family History Society if you need advice. These records are fascinating, because they will tell you not only who was buried when, but how – the relative spends on funerals vary from parsimonious to lavish – and also who paid for it.

Death is one of the great certainties in life: taxation is the other, and we’ll take a look at that next time. Until then – À bétôt!

Researching family in Jersey, part 1: where to start

You’ve traced an ancestor to Jersey, and you are wondering what you can find out about them. To your frustration, you rapidly discover that birth marriage and death records for Jersey are not available online. So what can you do?

Well, there are at least some useful Internet resources out there to help you get started. The most obvious one is the Census: Channel Island censuses from 1841 to 1901 are available both through Ancestry and Findmypast, and the 1911 census is on FindMyPast and will soon be fully available on Ancestry too.

A word of caution, though: the transcription is not entirely reliable on either site, and on top of that, some database search engines have problems with “divided” surnames like Le Sueur or Du Feu (not to mention Le Vavasseur dit Durell). So here’s a shameless plug: if you are going to do a lot of searching of censuses, you could do worse than purchase the paper census indexes produced by the CIFHS. They are a lot more accurate (well over 99%), and can (with a bit of fiddling) be cross-referenced back to the census images on the Internet.

There are also military records. If you’re looking at Channel Island relatives who served in the First World War, it’s well worth investigating at greatwarci.net – this is the website of the Channel Island Great War Study Group, and they maintain a very comprehensive list of people who served. The list is rather more complete than Ancestry’s transcript of what’s in the National Archives simply because Jersey residents served not only with the British armed forces but also with the Canadians and Australians. There were also at least a couple of thousand French nationals who joined up with the French military, but records for them are very scanty. If you are looking at other periods (and bear in mind Jersey had a garrison to protect it from the French right up until the 1930s), you may find references to service in Jersey on the military records of Chelsea Pensioners kept on FindMyPast, or on the GRO Regimental Indexes of birth marriage and death.

There are other useful resources too on Ancestry. There are three Channel Island postal directories – covering 1839, 1903 and 1927 – that may help to link a name to an address.

You may also be fortunate enough to find online family trees. Ancestry host them, as do Genesreunited, and there are also numerous independently-produced web sites. The general rule of thumb is to treat these as a guideline: they may be inaccurate, or they may tell the truth as far the researcher knows it – but not the whole story.
