Medieval Genealogy Difficulties

If we are to go back before the start of Parish Records being kept, in England that would be the year 1538, then no official records will have been complied on who was born, married or died in the country. It may have been the case that the priest in charge of a parish kept notes of what was happening in his church, but there was no official or standard form that they would have been kept in.

Records for the landowning members of society are much more likely to have been compiled than for the poorer classes of England. That said, however, records of people from the time do exist in the form of documents complied for other purposes rather than to detail the life events of a particular person.

Many of the records that have survived were produced for the Exchequer, Chancery and the law courts, or they relate to the land laws of the country.

A problem, for us in the twenty first century looking back, is that these records from medieval time are most often written in Latin and an abbreviated form at that.  English began to be used from the late fifteenth century in more informal documents, but even so we are then faced with the old handwriting of the era and so it is not such an easy task.

Help Me To Get Back Before 1837 In English & Welsh Genealogy

A great many people who are researching their forebears from the British Isles, discover that there is a massive amount of family history information on the internet for the years going back as far as 1837 in England & Wales. Then, as I pointed out before in a previous article of mine about tracing an English family tree before 1837, it would seem to become more difficult for us researchers. What is the significance or the year 1837? This is the date when civil registration started in England & Wales. The state took over from the established church the registering of all the citizen’s vital records.

You may have been amazed at the ease you had finding later records of your ancestors on the subscription websites like Ancestry, or TheGenealogist.co.uk, but then as you go back before the census records and the government run data for Births, Deaths and Marriages, you will have found that only a small number of all the genealogical records, that there actually are, have made it on to the net.

Parish Records can usually be found in the County Record office, or in a few cases the incumbent minister may still have retained them at the parish church. How do you decide which parish your ancestors would have fallen into? This is the value of getting hold of Parish maps for the relevant counties that you are researching. These maps will not only show the boundaries of each parish, but also those of the adjacent parishes, which can be extremely useful for tracking those ancestors who tended to move about!

Gaps can occur in the parish registers because of changes in regime, such as the English Civil War. Yet another political reason for missing parish records is the effect a tax can have on them. An example of this was that in 1783 a stamp duty of 3 pence on every entry in the parish registers was imposed by the government of the day – although paupers were exempt. As with all taxes people seek ways to evade them and so, with the collusion of many church ministers, you will discover that there is a decline in the number of middle and working class entries of baptisms, marriages and burials. In contrast there is a corresponding increase in the number of pauper’s entries! The Act was repealed in 1794, having been found to be largely unsuccessful.

An Act of Parliament, in 1812, required baptisms, marriages and burials to be entered in separate and specially printed books. These books provided for only eight entries per page and required more information to be gathered on the individuals than had been the common practice.

Baptismal entries now included the Father’s occupation and the Mother’s maiden name. Marriages, henceforth, included the parish of origin of both parties, their names, if they were a bachelor, spinster, widow, etc., their ages, the parties signatures or marks, and also those of two witnesses.

Entries for burials now included the age, occupation and abode of the departed and between 1678 and 1814 an affidavit had to be sworn that the deceased was buried in wool to help the economy or a fine of £5 was payable.

Marriages could have been solemnised in the Church either by banns, or by licence. Family historians, searching for their ancestors, will find that banns are recorded in the parish register. The reading of bans was the process where the couple’s intention to marry would be read out on three occasions in the parish churches of both parties. So if you know the place where the bride-groom lived, just prior to his marriage, this record will also give you the information as to the parish of his bride. Normally the wedding is likely to take place a few weeks later and so this gives you a time period to search. Marriage Licences themselves will probably not have survived the years as they were sometimes handed to the couple intending to marry. But fear not, because a search can be made for the marriage licence’s bond, or allegation. This is a document that can give up some useful information for family historians as names of those who stood surety, along with the names of the bride and groom, place of marriage and in some cases the occupations of the sureties and groom are recorded.

Why do we talk about the year 1837 in English & Welsh Family Tree research? Well this is when the General Register office or GRO was founded and That’s when and civil registration took over from the church in England and Wales.

The reasoning behind it was that the powers that be wanted to centralise data on the population. Consequently two Acts of Parliament were brought in to law by the Whig Government of the time.

1. The Marriage Act – which amended existing legislation for marriage procedures and brought in the addition of the registry office marriage; that allowed non conformist to marry in a civil ceremony. It is for that reason that you may sometimes see this piece of legislation referred to as the “Dissenters Marriage Bill”

2. Act for Registering Births Marriages & Deaths in England – which repealed previous legislation that regulated parish and other registers.

The new laws brought with them a change with 619 registration districts coming into force. These districts were based on the old poor law unions and so England & Wales were divided up into these districts for the purpose of civil registration.

For each of these districts a superintendent registrar was appointed. Further sub-districts being created within the larger unit and so from the 1 July 1837 all births, civil marriages and deaths had to be reported to the local registrars, who in turn sent the details on to their superintendent.

Every three months the superintendent-registrars would then send on the details gathered in their own returns to the Registrar General at the General Register Office.

So what was the case for church marriages? Well the minister was, in a similar manner, charged with sending his own lists to the GRO where the index of vital events were complied. This system means that many of us are able to simply find our ancestors in indexes and order copies of certificates back as far as the third quarter of 1837.

Marie-Louise Backhurst has written an expert introduction for the family historian tracing forebears from these islands which, while not part of the United Kingdom owe alligiance to the English Crown. Indeed, the author refers to them as being officially “Islands in the British Seas”.

 

For those who need to trace their family history within these self-governing smaller British Isles, where the laws and customs are sometimes very different from the “mainland”, then this work will point you to the wealth of material available to researchers in libraries and archives in Jersey, Guernsey, Alderney and Sark. As an example, civil birth, marriage and death records are different in format from those in England and Wales. The family history researcher will also find that they are only available in the islands themselves and the book gives the reader full information on how to gain access to them.

 

Marie-Louise Backhurst sets out to cover the census data, church records, nonconformist registers, rating lists, newspapers, wills and inheritance, official records, as well as a variety of other sources which can help top flesh out a Channel Island ancestor’s life. More Parish Records Online for Family Historians

I am spending a lot more time trying to find Parish Records these days and it is refreshing to see that more are making it onto the internet.

Take, for example, the two major sets of records that consist of data for generations of residents of Liverpool that Ancestry.co.uk released in April of this year. Three million Roman Catholic and Church of England baptism, marriage and burial records, fully searchable is a fantastic resource for those family historians researching in this major English city.

The Liverpool Catholic Registers, 1750–1900, span 150 years  and contain 1.6 million Catholic baptism, marriage and burial records. These will be of particular interest to the 136,0002 Liverpudlians today of Irish descent.

The 1.8 million Liverpool Church of England Parish Registers, 1659–1974, will equally be a significant resource for those tracing ancestors from the Protestant community of Liverpool. When one has got back before 1837 and the time when Civil Registration came in, these Parish Registers are the best way to find births, marriages and death records. No doubt this data set will really help people to trace their northern ancestors back to the 17th century.

The records, contained within these two particular collections, span over four centuries and witness the development of Liverpool from little more than a small town in the 1600s, to one of the UK’s largest and most culturally diverse cities.

It was during the 17th and 18th centuries that Liverpool’s population steadily grew. Come the 19th century, Liverpool expanded to become the second port of Britain and also one of the major centres for the trading of cotton, the importation of food and raw materials, the exportation of manufactured goods, coal, the insurance industry, banking and, of course, shipping.

The release of a database for a city such as Liverpool, with its many parishes, will allow family historians to search many parish records at once, a valuable time saver. The fact that people will be able to see digital copies of the original records is also another significant plus point for this Parish Records release on the internet. Not having to rely on transcriptions is a real bonus for researchers. Looking forward to more such releases in the future.

Manorial Documents in English Family History Research

Ancestral Trails-The Complete Guide to British Genealogy and Family HistoryI’ve been dipping back into Mark Herber’s book “Ancestral Trails” published by The History Press 2005, looking at the subject of researching back before Parish records started in the mid-16th century. He warns his readers to expect difficulties tracing their ancestors in that time. It seems that before then, you are only likely to come across sporadic references to your ancestors – or perhaps more properly people who could be your ancestors – in wills, tax records or court documents. Herber writes that “… you are unlikely to be able to trace a line of descent in this period (and in particular find documents that evidence that one man was related to another) unless you find your ancestors in property records.”

Now property records can be found for people from various classes, those who were substantial land owners and also yeoman, tenant farmers and labourers. This is why it is said that English manorial documents are perhaps one of the few types of records in which genealogical information about the common man, as opposed to those from the upper classes, is likely to survive from medieval times.

So what was the manorial system?

In the England of the Middle Ages, land was held from the English monarch by a lord and on his land the peasants worked and received his protection in return. Anglo-Saxon society was, as in most of the other European countries, rigidly hierarchical. Social status depended on birth and family relationships. Power was gained through the ownership of land, as this was the principal source of wealth at this time.

After the Norman conquest of England all the land of England was deemed to be owned by the monarch. The king would then grant use of it by means of a transaction known as “enfeoffment”, where land grants or “fiefs” were awarded to the earls, barons, bishops and others, in return for them providing him with some type of service.

There were two sorts of tenure, according to the type of service rendered by the tenant to the lord, free and unfree. Free tenure can then be broken down into different forms again. A tenure in chivalry, for example “tenure of knight service”, would be where the tenant was charged to provide his lord with a number of armed horsemen. Mark Heber in Ancestral Trails points out that this type of tenure was soon commuted to a money payment (or “scutage”). He also explains that among the types of “free tenure” was to be found “spiritual tenure” where divine services, or “frankelmoign” by which a clergyman, holding land from the lord of the manor, would pay his due in prayers said for the lord and his family.”Socage tenures” existed where the tenant provided his lord with agricultural services such as ploughing the lord’s retained land for 20 days a year.

“Villein tenure” or unfree tenure applied to those men known as villeins, serfs or bondmen. This class of tenant was not free to leave the manor without obtaining the permission of the lord. They would be subject to many obligations, some of which were onerous and these individuals held their land in exchange for providing the lord a number of days work in return. This could be, for example, four days work a week -  but the nature of the work could vary depending on what was required.

Manorial Documents are fascinating for family historians, as are will documents that were not the exclusive preserve of the rich. I shall explore this area again in other posts.

Researching family in Jersey, part 4: BMD records after 1842

Jersey FlagAfter 1842 registrations of birth marriage and death were made by Jersey’s twelve civil parishes – a system that carries on to this day. This presents some interesting challenges. Whereas in England records used to be kept by the quarter (meaning you could pin a birth down at least to a year), most Jersey parishes simply run 500- or 1000-entry books for as long as it takes to fill them up. The largest parish in Jersey, St Helier, has (these days) a population of about 30000 and the main hospital – so it fills up a 1000-entry book about every 18 months. The smallest parish, St Mary, has a population of 1500, and takes the better part of a century to fill up a book! The other point with this is that if you don’t know where a birth or death took place, you will have to search twelve indexes…

The indexing of the books is rudimentary. Entries are added by initial letter of surname in the order in which they are added to the book, with a reference to the relevant page number. And for this purpose a name like Du Feu is indexed under letter F. If you think this is bad, spare a thought for anyone researching the (not uncommon) surname Le Vavasseur dit Durell – which goes under D for Durell.

Marriages present the same problems as births and deaths, but rather more so. In time the civil parishes split their registers into Church of England marriages and those carried out by a registrar – the latter covering registry office, Roman Catholic, Methodist and other religions. And as St Helier grew and new churches were opened to serve outlying areas, these churches also came to the point where they took on their own registration books: so you could need to look at anything up to thirty index books.

There is, however, one case where Jersey practice is much better than English, and that’s in how we record deaths. Death register entries are made in the name under which the person died and any previous names they were known by, and the indexes include references for all these names. The grandmother of my wife’s great-aunt died in St Saviour in 1915, and we found an entry in the expected name of Sparkes – but we found three other married names and her maiden name too.

The actual registers are kept by the Superintendent Registrar in an office on the Royal Square in St Helier. The office is open 5 mornings a week – except that as it’s also the civil Registry office, it may be closed if a wedding is taking place. It’s worth a check in advance if you’re coming from a distance.

Researching Family in Jersey, Part 3: Jersey Parish Records

Most people will have at least some research to do which involves vital records – births, marriages and deaths. As in England, there are two categories of records. There are those kept by the state authorities – which record birth, marriage and death – and there are those kept by churches and record baptism, marriage and  burial. Jersey began civil registration in August 1842, but in this blog we’ll be looking at the parish records.

Parish records are available at the Jersey Archive. You won’t get to see the original registers, but instead there are copy transcripts made by the CIFHS. These go back to at least the late 17th century, and in some cases right back to the middle of the 16th century. Most of the transcripts end at 1842, but there are some more recent records available for the parishes of St Helier, St Martin and St John.

A typical entry in the baptism register might look like this:

Notice the way that record is made. First of all, it’s in French – Jersey was very largely French- or Jerriais-speaking until the middle of the 19th century, and a lot of legal records long after that were kept in French.

More importantly, you will spot the fact that the mother’s maiden name is used. There were good reasons for this. In most parishes there were a relatively small number of surnames and forenames: as we observed last time there might be  several Philippe Du Feus living in one parish at the same time, and this helped to clarify who was who.

There are a couple of potential pitfalls to watch out for. Firstly, people were not always consistent about how they spelled their names – but the CIFHS transcripts usually gather the different spellings (for example Romerill, Romerill, Romrill, Rumerill) under a single heading. Secondly, it is always worth carrying out a check both of the married and the maiden name if the person you are looking for is female.

If your ancestor wasn’t a member of the Church of England, you might be less fortunate. There are records from two of the big Roman Catholic churches in St Helier (there were two because one was French-speaking and one was English-speaking), and there are a few records from non-conformist churches, but they are rather patchy.

One more thing to add on the parish records: work is in progress to digitise them and make them available online, hopefully towards the end of 2011. Next time we’ll look at the civil records – until then, À bétôt!

I had to be up, showered and breakfasted for 6 am, in order to make my way to Jersey airport and the 7 am “red-eye” to London Gatwick. The fact that I, not in any way a morning person, was prepared to do this stems from the timetable of workshops that I had seen for the Who Do You Think You Are? LIVE show at Olympia.

First on, in the Society of Genealogist’s Regional theatre was “Researching Your Family History in Jersey” given by Sue Payn and James McLaren and I really wanted to be there for the workshop. My bus to the airport, the flight to London and the coach transfer to central London all ran reasonably to schedule and so I was in the building by 10.15. and taking a seat in time for the presentation.

James’ began by clearing up the perennial misunderstanding by people from outside of the island, regarding Jersey’s constitutional position. As a Jersey born and educated person, myself, I have spent most of my life making similar statements to his and so a smile warmed my face as the familiar words rang out.

I am often heard saying that we are not part of England and Wales, nor are we part of Great Britain, nor the United Kingdom and we are not in the EU, but are British Islands.

As James said: “We are a Crown Dependency: we owe allegiance to the British crown, but in most other respects we are self-governing. We have our own legal system, large parts of which are quite different from English law. In this respect we are similar to Guernsey, but please understand that we are not the same! It’s like the difference between a Mercedes-Benz and an Austin Allegro – the principle is the same, a vehicle that gets you from A to B, but the detailed implementation is rather different.”

This brought another smile to my lips as the old rivalry, with our sister Bailiwick of Guernsey, was introduced to the good folk in the workshop. Both Bailiwicks trace a Norman heritage and when in 1204 King John lost his French possessions, the Channel Islands kept allegiance to the British Crown.

One of the first things you are going to find, if you are researching your ancestors from Jersey is that the records are invariably going to be in French, as this was the official language of this island until very recently when English has become dominant. James pointed out that Jersey was very largely French or Jerriais-speaking until the middle of the 19th century, and so a lot of legal records long after that were kept in French. The deeds to my house, for example.

I have often heard people in the island refer to these documents being written in “proper French” to distinguish the language used from Jerriais, the name given to the Jersey French patois spoken in the island, which even comes with variations in pronunciation across the 45 square miles of the island!

Jersey people have always travelled far from their island; some to settle away in places such as Canada, Australia and of course to the United Kingdom. Some stay and some return. As James said the reason Jersey folk travelled was “– partly because of our rules on inheritance, partly because there was money to be made in trade, partly to serve Queen and country in the armed forces, and more recently because the only way to get higher education was to go to the big island to the north of us. Consequently there are numerous people in the UK who have Jersey ancestry somewhere in their past.”
