Researching family in Jersey, part 7: Property Records and PRIDE

Establishing who owns land or a house on it is important, and pretty well every country has a land registry. Jersey’s is small but perfectly formed because every property transaction goes before one single body, the Royal Court. Apart from a small number of mid-17th century transactions, records are complete back to 1602. The first 150 years of records are on paper, but everything subsequent to about 1800 has been scanned and indexed into a computer system called PRIDE. There are two terminals at the Archive. One is upstairs in the reading room, the other is downstairs in reception – which is exceedingly useful as it can be used between 1pm and 2pm when the reading room is shut. You will need a member of staff to log you on.

PRIDE has a very simple search interface, and for most purposes you need a name to investigate, but it can be a hugely useful tool. Not only do you find sales of property, but after 1841 you will also find wills and details of partages – arrangements which exist to deal with the complexities of Jersey’s Norman-based system of inheritance.

You will also find details of rentes. Rentes are a little like a mortgage – you agree to long-term instalment payments in return for a capital sum – but unlike modern mortgages they are theoretically perpetual, and they can be inherited or traded between individuals, although there are very few left today. Also on PRIDE you will find details of procurations – in other words, appointments of attorneys to act on behalf of an individual – for more recent times.

If you start in modern times – after about 1980 – you can search properties. Any sale contract has to include a recital of title – in other words, who the seller acquired the property from and when. If you are fortunate it is then possible to work back up the chain…

Even if you don’t understand all of the legal niceties, PRIDE can still be hugely informative. A search for Philippe Du Feu threw up a document dated 1826. It didn’t actually concern Philippe so much as his wife Elizabeth Amy: the Amy family had created what we call a partage des heritages to ensure that the five daughters were provided with money for homes by their brother who had inherited the estate. In doing so the document gives us the names of all of Elizabeth Amy’s siblings, the names of their husbands (if they were married at that point), her parents, her brother’s grandparents and several aunts and cousins. None of that detail is on the Du Feu family tree. And study of the contract itself could give a great deal more information to the family historian – how generous the settlement was (or wasn’t) could indicate the social standing of the family.

More Data Released by TheGenealogist.co.uk

I like to keep you informed about new releases in the British Isles family history niche and so today I was looking to see what was new at TheGenealogist.co.uk.

Of interest to me was the fact that they have added over 3,000 individuals to their Parish Transcripts for Devon, expanding their coverage and bringing the total to over 66,000 individuals. The date ranges are different for baptisms, marriages and burials and are:

Baptisms: 1594 – 1944
Marriages: 1538 – 2009
Burials: 1593 – 2009

For those of you researching other parts of the UK, I also noticed that they have recently released hundreds of thousands of other parish record transcripts, for several counties of England, which has got to be good for those of us trying to get back before 1837 in England & Wales.

While for family historians, who are looking to do some research in the opposite direction and trying to find ancestors later than the 1901 census, TheGenealogist.co.uk has now launched the first county of the 1911 Census on their site. They say that their colour images are of a higher quality and higher resolution than those that have been available online before, so this could be interesting when looking at the handwriting of our actual ancestors.

In a recent news update, that I had from them, I see that they are now also making available pre-1841 census records and various Scottish Census records for 1851. The pre-1841 census in question is for Marylebone in London for both 1821 & 1831. The details only include the surname of the head of household and street name, unlike the later census. None the less, this could be of great help to some researchers trying to find their ancestors. To search these new records, simply go to TheGenealogist.co.uk, log in and select the London census from the research view and then change the year to 1821 or 1831. Yet another data set, announced by the site, is the release of the Australian transportation records. These records take the form of transcripts, but with access to images of The Convict Transportation Registers 1787-1867. Covering details of over 123,000 of the estimated 160,000 convicts who were transported to Australia during the 18th and 19th centuries, the records mainly include those convicted in England, Wales and Scotland, but also include a small number of Irish convicts.

The database also includes soldiers who had been court-martialed and sentenced to transportation. These ‘soldier convicts’ may have been convicted in various British colonies, including the West Indies, Canada, India, and Pakistan. You’ll find these records in the British & International section of The Genealogist.co.uk’s research view.

British Library and findmypast.co.uk to give us 5 million pages of family history records online!

That great institution, The British Library, is joining up with family history website findmypast.co.uk in a project that I find exciting, as some of my Scots ancestors went out to British India to find their fortunes in the 1860s, while others stayed put in the UK.

What has been announced, by these organisations, is their intention to digitise a veritable treasure trove of family history resources held by the British Library and so making them available to us online and fully searchable for the first time.

To be scanned are the United Kingdom electoral registers that span the century which followed on from the Reform Act of 1832, along with records of baptisms, marriages and burials that have been drawn from the archives of the India Office.

These collections are going to allow us the possibility of tracking down details of our forebears from our computers instead of making a trip to London and the British Library’s Reading Rooms.

The British Library houses the national collection of electoral registers covering the whole of the United Kingdom and contain a vast range of names, addresses and other genealogical information, so you can see their importance.

“Digitisation of the electoral registers will transform the work of people wishing to use them for family history research,” said Jennie Grimshaw, the Library’s curator for Social Policy and Official Publications. “Printed electoral registers are arranged by polling district within constituency and names are not indexed, so the process of finding an address to confirm names of residents is currently incredibly laborious. Digitisation represents a huge breakthrough as users will be able to search for names and addresses, thereby pinpointing the individuals and ancestors they’re looking for.”

Also to look forward to, in this large-scale digitisation, are records taken from the archives of the East India Company and the India Office and thus my excitement as so many of my Scottish ancestors were employed in the H.E.I.C.S. The data that we are promised relate to Britons who lived and worked in the Indian sub-continent during the eighteenth, nineteenth and twentieth centuries, up to Independence in 1948. Including over 1,000 volumes of births, marriages and burials, together with applications for civil and military service, and details of pension payments to individuals.

Antonia Moon, curator of post-1858 India Office Records said, “These records are an outstanding resource for researchers whose ancestors had connections with British India, whether as servants of the administration or as private inhabitants.”

We can expect to see five million pages of UK electoral registers and India Office records digitised over the next year. The resources will become available via findmypast.co.uk and in the British Library’s Reading Rooms from early 2012; online access will be available to findmypast.co.uk subscribers and pay-as-you-go customers – access to users in the British Library Reading Rooms will be free.

Simon Bell, the British Library’s Head of Licensing and Product Development, said: “We are delighted to announce this exciting new partnership between the British Library and findmypast.co.uk , which will deliver an online and fully searchable resource that will prove immensely valuable to family history researchers in unlocking a treasure trove of content that up to now has only been available either on microfilm or within the pages of bound volumes. The Library will receive copies of the digitised images created for this project, so as well as transforming access for current researchers, we will also retain digital versions of these collections in perpetuity, for the benefit of future researchers.”

Elaine Collins, Commercial Director at findmypast.co.uk, said: “We’re very excited to be involved with this fascinating project. The electoral rolls are the great missing link for family historians: after censuses and civil registration indexes, they provide the widest coverage of the whole population. To have Irish and Scottish records alongside England and Wales is also a huge advantage. These records will join the 1911 Census, Chelsea Pensioner Service Records and many more datasets available online at findmypast.co.uk, which enable people to make fantastic discoveries day after day.”

I, for one, can’t wait!

Tracing An English Family Tree Before 1837

When you are tracing your ancestors in the British Isles there is a rich seam of information on the internet until we get back to 1837. This is the year when civil registration began and the state took over the registration of its citizens vital records.

Many newcomers to English and Welsh family history are amazed at how easy it is to go to one of several websites, pay a subscription (or buy some credits) and begin finding records of ancestors with relative ease. Lulled into a false sense of security, we begin to think that all the information that we will ever need to find, for our family tree research, is going to be accessible online. But soon you find that quite a small percentage of all the genealogical records, that there are, actually make it on to the net.

So what are the other records that family historian with English or Welsh ancestry need to go hunting for? How about wills; manorial records; the many types of occupational records; various military service records; or, if like me you had a merchant seaman in the family, then the merchant navy’s records? This is just a short list, there are more!

What About Research Before 1837.

Once you have been able to get back as far as you are able to do, using the census entries and Birth Marriages and Death records, you will now need to turn your attention to Parish records – these date back to 1538 and a time when Thomas Cromwell, Chief Minster to Henry VIII, ordered that every wedding, baptism and burial should be recorded. Historically, England and Wales was divided into about 11,000 parishes. Your research will need to be in the Parish Registers relating to the place where your ancestor lived, in order to find out as much information on your forebears line in that parish.

Where should you look for parish registers? The answer is that the original will normally have been microfilmed and stored in the local County Record office. True that there are a few parishes where the registers are still with the incumbent minster; but the majority are now in the safe keeping of the relevant record office. An alternative, to looking at images of the original record is, if you have access to the web to go and look at the websites that offer transcripts of Parish Register for you to search. Remember, however, that a good genealogist will always understand that a transcription is secondary data only. It is an indication of information for you to follow up and so you do need to then go and confirm the details by looking for the original source. The reason is that errors may possibly have been made by the person making the transcription and you don’t want to allow those errors to get into your own family tree, now do you?

While English and Welsh parish records stretch back as far as 1538, not all will have survived the ravages of fire and flood, so don’t expect to be able to sail back as far as this date! The earlier records were recorded on paper, but from 1558 onwards the more durable parchment (made from sheepskin) was used in preference. Even so, very few parish record survive before the 1600s.

From 1598, annual copies were made and sent to the local bishop. Called Bishops’ Transcripts (or Register Bills in East Anglia), these make a good substitute for lost original records, and occasionally contain information omitted from the registers themselves. These Bishop’s Transcripts will often be in a better condition and also more legible than the original parish register and they can be found in the county record offices. While the older records were, in theory, supposed to have had copies made, it is believed that some never managed to be copied and others have been lost over time.

Family tree researchers need to be aware that there can be gaps in Parish Registers between 1553 and 1558 when Henry VII’s daughter Mary Tudor, a Catholic, was on the throne. Also there is the so called “Commonwealth gap” between 1642 and 1660 in the English Civil War and under Oliver Cromwell’s protectorate.

I was doing some research on the web today when I chanced on this article. I think it is worth republishing here, as the advice it give is so good.

A question I am often asked is how do I trace my UK family tree?

Taking the journey into the unknown territory of the past can be a mixture of exhilaration and tedium. You will meet with misspelt names, birth dates that vary from one census to another, missing ancestors and be led down blind alleys. But when you finally meet up with that elusive ancestor the joy of success will spur you on with your research.

Like every good journey it starts with the first step, so buckle up your genealogical seat belt and Ill guide you through the first important stages.

First find any birth, marriage and death certificates, correspondence, insurance policies, ration books, etc. These will be of great help to you as you start your research. Anything that will give you details of your parents or grandparents. Gather up as much information as you can and jot it all down to start your tree. Lay the tree out as the youngest first and work back. You can download blank family tree charts on our site if you wish, then start completing your family tree as far back as you can.

Keep detailed notes on each person. You will thank yourself for this action when you find that you are retracing back and forth to verify information. I cant stress this enough, you must be sure that you have the correct records for your ancestor, not somebody else’s. It is quite an easy mistake to follow the wrong family back through the centuries as names can be similar and sometimes the same. I found that my great, great, great grandfather had a detail double, with the same name, the same year of birth and the same place of birth. It took 2 months of research into each one, retracing details back and forth to tie in the right man! I almost felt I could claim the other man as an ancestor, I knew him so well in the end!

Your initial aim is to collect enough verified information to take you back to 1911, at which point you can delve into the world of census records and begin to unlock the doors to your past. Within the census your ancestors will come alive for you.

Don’t worry if you cant find any certificates lurking in drawers or boxes, armed with only your parents names you may still be able to trace back through the years, although you will have to buy birth and marriage certificates. I managed to trace my family tree knowing only the names of my parents and their dates and places of their birth. I needed to buy my parents’ birth certificates so that I could find out their parents details, thus keeping the trail going.

To overcome this type of problem I recommend you sign up as a member of a genealogical website, and then start searching their records. My first search was my fathers name, date and place of birth the results showed all the possible matches with my dad at the top of the list. I clicked on the link and it took me to the registered GRO entry for his birth, which in turn gave me the index reference details:

  • Surname at birth
  • Forenames
  • Year
  • Qtr. (the year is broken into 4 quarters)
  • District
  • Vol.
  • Page

Every event of birth, marriage or death registered in England and Wales is allocated a reference by the General Register Office. Next I went to the GRO website (www.gro.gov.uk) and purchased my dads birth certificate. I repeated the same process for my mum.

By supplying the index reference the correct entry can be located by the GRO and the certificate will be sent to you. You can also purchase certificates from registration offices, but if you want to research online without having to travel miles then the internet is the way to go.

I sat back and waited for the post, it took about 7 days for the certificates to arrive. I opened them with anticipation and I wasn’t disappointed. I had in front of me the full details of my grandparents, their names, addresses and occupations. I used this information to find their marriage, which in turn gave me their fathers names and this was all I needed to take me back to the census records and from there fly back in time to meet my older ancestors.

Bankrupt Ancestors in Your Family Tree!

We all know that in today’s new economy people are getting themselves into debt. Worse still, for some, is the prospect of going bankrupt. It may seem that bankruptcy is a modern phenomena, well it isn’t. Getting into debt was also a common problem for our ancestors as well. As we all love a skeleton in the cupboard, just how can we find out if one of our family has had the problem to face back  in the Britain of the past? It would seem that we may be able to find out more online.

In my research into my family tree I remember chancing on some family notes that, on face value, seemed to identify one of my ancestors as having been a partner in a business enterprise that had failed. To start with I had had no inkling that my forebear, in question, had even been a merchant, so to learn that his enterprise had eventually hit the rocks was an interesting nugget of information in itself. As a bookseller, myself, and having read the Charles Dickins novel called Little Dorrit, which you will no doubt know is set in within a debtor’s prison, I wanted to find out if my own ancestor had faced being declared bankrupt.

In England, Bankruptcy goes all the way back to a statute of Henry VIII in 1542. The 1571 Bankruptcy Act brought about the idea that a bankrupt person would be able to settle their debts, by distributing what remaining assets they had, through independent commissioners. Up until 1705  the unfortunate debtor could never be discharged from bankruptcy and so the stigma would remain with them for ever!

Legally, Bankruptcy is a process in which a court official assumes charge of a qualifying debtor’s property so that a distribution can be made to the creditors of the debtor in a proportion to the sum that they are owed.

Only in the year 1869 was it that individuals who were not undertaking a business  of some sorts were able to become bankrupt. Before this date, ordinary people were known as being insolvent instead. These souls faced being sent to debtor’s prison and were not released until they had found a way to pay off their creditors. Bankruptcy, as such, applied strictly to people who were traders, that is those who bought and sold goods, or who worked some materials into things that they then sold.

District bankruptcy courts were first established outside of London from 1842. Then their jurisdiction passed on in 1869 to the County Courts. In the capital city the London Court of Bankruptcy was set up in 1869, before being absorbed into the High Court of Justice in 1883. Should you wish to find details of what’s available for you to search then I recommend taking a look at Access to Archives at http://www.nationalarchives.gov.uk/a2a/

Independent assessors, known as Commissioners, would determine if a debtor was eligible for bankruptcy or not. If they were satisfied that bankruptcy could take place, then they would publish a notice in the London Gazette declaring the debtor bankrupt. Also posted would be a list of potential creditors along with the dates set for meetings. The London Gazette’s archives are easily searched today on-line at www.london-gazette.co.uk. This is a fantastic resource  for any family historian hot on the trail of a bankruptcy. You are able to search the archives by date and name, then view a pdf image of the pages that your results have found. The London Gazette has been published since 1665 with a regular publication of bankruptcies stretching back to 1684 and also 1712 for insolvent debtors. Scottish notices can be found in the Edinburgh Gazette at : www.edinburgh-gazzette.co.uk

Family historians can locate case files for English bankruptcies at The National Archives in Kew, while Scottish sequestrations are to be found at The National Archives of Scotland. Unfortunately, for us, the majority of case files for England have not survived, but those that have are indexed on TNA’s online catalogue.

Other resources to consider are journals that published similar notices to the gazettes. These will include The Times; The Gentleman’s Magazine; Perry’s Bankrupt & Insolvent Gazette (1828-1861) and Perry’s Bankrupt Weekly Gazette (1862-1881). If you are looking for notices of bankruptcies in the County Court, then you will probably need to turn to local newspapers for the area in question. The British Library would be the place to look for these. Now we are also able to search contents of newspapers at http://newspapers.bl.uk/blcs.

Insolvent ancestors can be an interesting topic of research. Remember, however, that their hardship carried much more stigma than it does today. In modern times we can go into debt, declare ourselves bankrupt, or wipe out a huge chunk of our debt with the alternative Individual Voluntary Arrangement IVA. And yet none of us lives in the fear of being incarcerated in the debtor’s prison in the 21st century.

Military Records in Family Tree Research

With Remembrance Sunday just passed yesterday, I guess many of you may have turned your minds, like I did, to where can we find our ancestors who fought in the wars and conflicts that have taken place.

It seems, rather sadly, that it is easier to find records for British service personnel that died in action than the survivors. There is the Commonwealth War Graves Commission, local war memorials and rolls of honour, local newspaper archives amongst other places to find “The Glorious Dead”.

If, like me, you had a father who served in the Merchant Navy in the Second World War, then you can find the details of merchant seamen’s medal cards at the National Archives documents online.

The official journals of the the British Government, the London, Edinburgh and Belfast Gazettes are great places to start looking for promotions, awards of gallantry medals and honours and the details of the commissioning and promotions of officers in the British Army, Royal Navy and Royal Air Force.

Service Records are more difficult to find. A large number of WWI records have been lost to bombing in the Second World War, but as officer’s records were not stored in the same place, you have a better chance of uncovering these. To find a soldier requires the researcher to know the regiment and service number of their ancestor. A tip I read in the Your Family Tree Magazine last month  (Issue 96 November 2010) was that as most service men were awarded at least one medal then the name indexes to the medal rolls are a good place to start researching.

What is the Biggest Family History Problem for Those Of Us With British Ancestors?

I put up an online survey to find out what major brick walls people had in British Isles ancestor research and the largest cry that came back was the following:

Help me with my family tree research, especially back before 1837.

Perhaps this resonates with you? You’ve traced your forebears back in the census collections as far back as the 1841 census? Then you have used the Births Marriages and Deaths on the web and found that the nice and easy indexes only go back as far as 1837?

It was, you see, that in 1837 the General Register Office was set up for England and Wales and took over the registration of vital records from the Church of England.

In Scotland it was in 1855 that the General Register Office for Scotland took the same powers from the Church of Scotland. So from those years backwards we all have to use the records kept by the state church and these are known as Parish records in both jurisdictions.

Baptismal registers will normally give you the name of the child and that of its father, plus the date of the christening. Occasionally you may also see the mother’s name, most particularly if the child was illegitimate. In this case you could see the terms “base born” “bastard” or “natural born” on the record. Sometimes the godparents or witnesses also appear. This all goes to show how there was no standard format to baptismal registers until in 1812 Rose’s Act became law in England and Wales and standardised the information to be recorded on specially printed registers. It should be noted, however, that Rose’s Act did not apply to Scotland or Ireland. These new standardised registers asked for more details than before and so now the clergy had to obtain the mother’s Christian name, the father’s occupation and his abode.

Churches kept parish registers locally. They were not collated or sent to any central depository but were retained by the churches themselves. From the 16th century up until 1837 the parish church carried the responsibility of collecting records of its parishioners. While baptism was more important to the church than actual birth dates and burials were noted as opposed to deaths, the church was essentially an arm of local government.

A strong lockable box, known as the parish chest and into which were deposited records were kept. We refer to all those records, that may now be found deposited in the county record office but were once in the keeping of the parish church, as Parish Chest documents. They don’t just include the well known parish registers of baptisms, marriages and burials of our forebears. You will find there are all sorts of other records that together are sometimes referred to as the parish chest.

In England and Wales you have the vestry meeting minutes while in Scotland you have the Kirk Sessions. There are also odd records such as the report of the parish surveyor! Many of you may not have even heard of such records that may just contain your ancestor’s name and if you are restricting your searching to the online environment then you are more than likely frustrated by the inability to locate them.

In most cases you are going to have to visit the county record office to get to see microfiche copies of these English and Welsh records, as they are not online. For the baptisms, marriages and burials you could go to your local LDS centre and order the films there. Scotland’s old parish registers, however, can be accessed at the ScotlandsPeople website for a fee. Oh that we could do the same south of the border!

Volunteer Family History Site Smashed My Brick Wall

If you are having problems researching your family tree then maybe you can learn something from my experience here. I had got nowhere with this ancestor’s birth, marriage or death – on or off-line – then a chance visit to a Family History Website and an hour or two looking at the transcripts and a brick wall in my family history research came tumbling down! This, together with thinking of spelling variations of names, opened up a new line to me.

My paternal line in Dartmouth, Devon, UK has always been a bit frustrating once the census records ran out in 1841. This being the earliest English census on-line after which I had to start looking at parish records. I had worked out that my three times great-grandfather was called John Thorn and from the information given in the census collections I knew that he had been born in about 1795 and his wife, Elizabeth, in about 1798.

As a member of The Society of Genealogists in Goswell Road, London EC1. I knew that they’ve the largest collection of Parish Records in the country on microfiche. They’ve also got some transcripts of parish registers in the library.

Unfortunately Dartmouth parish records were not microfilmed, but a selection of Devon Family History Society booklets of the marriages of some of the churches in the town, including St. Saviour’s, were available. Scanning one book for any likely ancestors I noted down that on 13 April 1817 a John Thorn married an Elizabeth Sissell. With this tentative lead, I hit the Internet. I was looking for any evidence that this was the marriage of my ancestors. I opened the Dartmouth-history.org.uk website of The Dartmouth Archives and found that this voluntary organisation had a very comprehensive family history section with transcribed baptisms, burials, marriages and census records. I could read the very same details, as I had seen in London, on this niche site. The information began in 1586 and ran to 1850! There was the marriage of John to Elizabeth and this time I noticed that the witness were given as John Adams and Sunass (sic) Sissell. I assumed that this last person was a member of the bride’s family and perhaps was her father, but the name Sunass caused me concern as it didn’t seem very likely and I guessed it couldn’t be read properly by the transcriber.

After doing family history for a few years now, I’m aware that names can be transcribed incorrectly. Perhaps written down as the transcriber had seen them (as best practice dictates) and not changed to conveniently fit in with what is consider to be correct. I wondered if both the first name and the second had not been written down by the person in question, as they may well have been illiterate. When you come to do your own research you should bear in mind this point. The minister may have interpreted the name as he had heard it spoken to him and so in this case “Sissell” could possibly been “Cecil” or something entirely different. As for Sunass – at this point I hadn’t got a clue what that could have been!

There were no early enough christening records for John and Elizabeth on the Dartmouth Archives website, but I opened another browser and navigated to the Latter Day Saints (LDS) website or FamilySearch.org and here I did a search for Elizabeth’s christening and was lead to a baptism in one of the other churches in Dartmouth, St Petrox, on the 16 September 1878. The daughter of James and Sarah Sissill was one Elizabeth Gardener Sissill – and here I noted that the spelling had changed to Sissill with an “i” and not an “e”. This record made me wonder if the witness to Elizabeth’s marriage could have been her father “James” and this has been interpreted as “Sunnas” because a flowing “J” for James had looked like an “S” and the other letters had been misread as a “u” for an “a” and the double “n” as an “m”.

So what I am emphasising here is to be wary of names and the way they were spelt. Before more general levels of literacy among the public became the norm, our ancestors relied heavily on a clergyman writing down their names as they sounded.

This breakthrough is down to finding that Dartmouth has an active family history website and then using their indexes in conjunction with other Internet resources, such as the LDS site. I could then take the names and details further by looking for death certificates for John Branton Thorn and his wife Elizabeth Gardener Thorn, as they had died after civil registration of deaths took place in 1837. From here a physical visit to the Devon Record Office to see the parish records may be the next step.

The first lesson is that you should always look to see what other research may have been done, for the area your ancestors came from, and that is published on the Internet. If you find a family history society, or local interest group with a website, can any of their publications or website pages help you with your quest? Secondly, be aware of the misspelling of names and keep your mind open to possibilities. In my case I need to think of other spellings for the Sissells or names that may have sounded like Sissell in order that I may trace this line back further and break down the brick wall.
